Terms and Conditions


These terms and conditions shall form and apply to the sale of the goods by the seller to the buyer.  By ordering from Little Artichoke Company Limited you agree that you are legally bound by these terms and conditions and accept that these conditions may be modified or amended and posted on this website from time to time.

By paying any monies you agree to the full terms and conditions outlined in this document.  Please ensure that you read through it to familiarise yourself with the terms.

Please note that these Terms and Conditions only relate to our cake and traybake orders. Once our classes go live we will be updating these.


Traybakes

All orders must be made by emailing [email protected]. We do not accept orders via social media or over the ‘phone. Once your order has been placed, payment is required within 24 hours or the order will be cancelled.


Boxes are sent using Royal Mail First Class post with the intention of arriving the following day. We keep proof of postage for a week once the box has been posted. Given the current delays in the postal system, we cannot guarantee next day delivery or accept the risk of boxes being lost in the post.

Our traybakes are sent out in durable postal boxes which are designed to protect the goods they are transporting. If your box arrives damaged then please get in touch at the earliest opportunity and enclose a photograph of the damage. We are unable to accept the liability of goods that have been damaged in transit.

At the moment, we are unable to make traybakes for specific dietary requirements but this is something that we are working towards.


Bespoke Cakes

Any samples, drawings, or descriptions we issue and any descriptions or illustrations contained on our website are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of Little Artichoke Company Limited.

Cake sizes are quoted in inches and are based on the diameter of the cake. Cakes are 4 inches deep as standard. If you would like a deeper cake this needs to be requested at the time of booking.

No contract is made with you and no order is confirmed until we have received your deposit. Once your deposit has been received you are in a legally binding contract with Little Artichoke Company Limited.


Quotations

All price quotations, written or verbal, are valid for 10 days from the date of the quotation.


Payments and deposit

We require a 50% non-refundable deposit to confirm a cake order and to hold the date. 

For wedding cakes and large celebration cakes, the remaining 50% final payment is due 6 weeks before the delivery or pick up date.

For celebration cakes, the remaining 50% final payment is due 2 weeks before the delivery or pick up date.

The final payment is the point at which the final design must be confirmed.  Changes to the previously agreed design may incur extra fees. Please note that it will not be possible to reduce the size of your order.

Orders placed less than 6 weeks (or 2 weeks for smaller celebration cake orders) of the delivery date must be paid in full.  Failure to complete final payment before the delivery date may result in your order being cancelled.  By making payment, the buyer is accepting the terms and conditions as detailed on this page.


Refunds

Deposits are non-refundable and non-transferable under any circumstances due to loss of business arising from turning away other bookings on that date.  Full payments made less than 6 weeks (or 2 weeks for smaller celebration cake orders) in advance of the delivery date are non-refundable.  Full payments made more than 6 weeks in advance of the delivery date are subject to a cancellation fee.  We cannot refund the cost of any orders cancelled with less than 6 week’s notice.

In the unlikely event that we have to cancel your order for any reason, then we will give you as much notice as possible and try to agree a suitable alternative. 


The Cakes

All our products are hand made and can be ordered in different sizes and design from those shown on the website.

We cannot guarantee an exact replica of any cake but we will do our best to make it so. Where colour swatches are provided we will do our best to match as close as we deem possible. Exact colour matches are not guaranteed.

Fresh flowers are not included in the price of any cake design unless otherwise stated. If a cake is to be dressed with fresh flowers these are to be provided by your florist.

Please note some flowers are not suitable for use as a cake decoration. Ask your florist for details regarding toxicity. We cannot be liable for any contamination to our food product that may arise from their misuse. We recommend that your florist liaise directly with us to confirm detail about the size of cakes to avoid any miscommunication.


Alterations

If you have any queries or need to make any changes to an order please contact us immediately. Alterations and amendments must be submitted in writing. We will assess the request for an alteration, and endeavour to make alteration where possible dependant on the design and amount of notice given. We will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. It is the Buyer’s responsibility to check any quotes and invoices thoroughly before making payment. We reserve the right to change the design at any point if circumstances beyond our control compromise the quality of the finished product. e.g. weather conditions. The Buyer will be notified of any such changes and we will endeavour to keep any changes minimal.


Delivery and collection

We cannot be held liable for any damage to the cake or products once it has been delivered or we have delivered and set up the cake at a venue or location.  We will require a signature for the safe receipt of the goods on our cake information sheet.

If cakes or products are collected from us, we cannot be held liable for any damage to the cake or products once they have left our premises.  The responsibility lies with the buyer.  Cakes and products are very fragile.  

Delivery times are approximate.  We will always endeavour to deliver the cake to you as close as possible to the given delivery time but we are unable to take liability for any delays outside of our control.


Storage and display of cakes

Cakes and goods should be stored in the box provided in a cool dry place, out of direct sunlight.  When cakes and goods are delivered and set up – if they are placed outside they are likely to react to the temperature.  In hot or humid weather there is a possibility of sugar decorations melting or damage to good.   Cakes are best eaten on the day of delivery.  Once cakes have been cut shelf life will be reduced.


Damages and complaints

In the unlikely event that your order arrives damaged, it is the customer’s responsibility to report the damage as soon as possible and no later than 24 hours.  The customer must send photographic evidence and if possible a sample piece of the cake.

The seller accepts no liability for cakes and products that are damaged after they have been collected or delivered to the agreed location.

If the customer is unhappy we would recommend getting in touch straight away, as some issues may be able to be rectified straight away.  However, once the cake information sheet is signed this confirms that the customer is happy with the decoration of the cake.

If the complaint is in regard to the quality of the cake, then the cake and the remainder of the cake must be returned to us as soon as possible after cutting and within 48 hours of collection / delivery to ensure that we are able to fairly access the nature of the complaint.
